Who Needs ESI Registration?

  • The Employees' State Insurance (ESI) Act, 1948 mandates that all factories and establishments, including private educational institutions, must obtain ESI Registration if they have:
    • 10 or more employees (in most states).
    • 20 or more employees (in some states).
  • This applies to all businesses registered under the Employee State Insurance Corporation (ESIC). Employees earning up to ₹21,000 per month (or ₹25,000 for individuals with disabilities) are eligible for the scheme.

Is it mandatory for the Employer to register under the scheme?

  • Yes, it is the statutory responsibility of the employer under Section 2A of the Act read with Regulation 10-B, to register their Factory/ Establishment under the ESI Act within 15 days from the date of its applicability to them.

Contribution & Benefits

  • Employers must remit ESI contributions from a percentage of the employee's monthly wages.
  • Contribution Rates are set by the Ministry of Labour and provide benefits like medical coverage and disablement support.
  • Both the employer and employee contribute, with the employer bearing a larger share.

ESI Registration Process

  • Document Submission: Employers must provide
    • PAN Card of the business.
    • List of employees.
    • Articles of Association (for companies).
  • Online Registration: The process is completed via the ESIC portal, where a unique 17-digit Registration Number is issued.
  • Employer Login: Registered businesses can manage contributions and compliance through the ESIC portal.

Additional Compliance

  • Employers must provide details of the health insurance scheme of the establishment.
  • Businesses must comply with state and central government regulations, including factory/establishment laws.
